You means you as a purchaser of my services or goods. 

Goods means the products and items  you purchase from me.  

I means me, Louise Powers.

Please read all these terms and conditions so that you understand your legal relationship with me when you purchase my services or goods. When you purchase my services or goods, I will ask you to confirm that you have read and agree to these terms and conditions before your order can be accepted.  If you do not agree with my terms and conditions, please do not place any orders with me.

2. Order goods from me

2.1 When you place an order with me for goods, you are making a legal offer to buy the goods. I will send you an e-mail to confirm that I have received your order.

2.2 In the event that the goods are no longer available, or that I have made a pricing error, I will tell you before confirming your order and in these circumstances there will be no contract between us. You may, of course, place a new order for the item at the alternative price.

2.3 Images of goods on my website are for illustrative purposes only. The goods you receive may vary slightly from the image shown on the website because of the natural qualities of the materials used or for other reasons.

2.4 I have made every effort to display as accurately as possible the colours of my goods on my website. However, I cannot guarantee that your device’s colour display will accurately reflect the colour of the actual goods.

2.5 Whilst I try to be as accurate as possible, all information provided is approximate and is provided in good faith.

2.6 By placing an order for goods with me, you agree to and accept these terms, as well as my privacy policy and the terms of website use.

3. How to place an order for my goods

3.1 You can use my website to place an order by selecting the goods you wish to buy and adding them to your basket. Anything you do not require can be removed from your basket at any time. 

3.2 If you wish to order a bespoke item, please write to me at loulou.powers@gmail.com with your requirements. I do not guarantee that I can meet your requirements but will try my reasonable best to do so.

3.3 You assume responsibility for the goods being suitable for the purpose for which they are being purchased.

3.4 Delivery charges will be shown prior to you placing your order.

3.5 You will be required to pay for the goods in full at the time of ordering.

3.6 I use secure payment facilities for online purchases. You can pay for your order by using Paypal or your debit or credit card.

3.7 All prices quoted on my website are in UK pounds. They do not include Value Added Tax at the current rate.

3.8 Once your order has been confirmed, if you want to make changes, this may not be possible or may incur additional charges or delays.

3.9 Once your order is complete I will notify you of the despatch date.

4. Delivery of goods

4.1 Goods will be posted by me within 2 working days of your order. Where this is not possible for any reason, I will notify you of the delay.

4.2 All goods will be posted using Royal Mail’s second class delivery service unless you choose one of the alternative delivery options available. 

4.3 Where your order comprises more than one item, they may arrive in more than one delivery.

4.4 If the goods do not arrive please report this to me within seven days from the estimated delivery date.

4.5 Time is not of the essence in the contract between us unless I agree a specific timetable with you and confirm it by email.

5. Cancellation 

5.1 In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have cancellation rights for all services and goods ordered over the internet within 14 days of placing the order, except for orders of less than £42 and any bespoke goods prepared to your specific requirements. 

5.2 You may examine the goods for 14 days after they have been delivered to you.

5.3 You can cancel your contract at any time up to 14 days after the day of delivery. To do this, you must send a cancellation email to me saying you wish to cancel. You must return the goods to me at your own expense and complete with the original packaging within 14 days after sending your cancellation email. If you do not comply with these timescales your right to cancel will be lost. 

5.4 I am unable to accept cancellations by phone. Please refer to point 5.1 for goods exempt from your cancellation rights.

5.5 You do not have to give any reason for cancellation. However, a brief explanation will help me to improve the services and goods I offer to customers in the future.

5.6 You must ensure that goods being returned are packaged adequately to protect against damage in transit.

5.7 If you fail to take reasonable care of the goods before they are returned to me and this results in damage or deterioration, I will charge you for the reduction in value.

5.8 I will refund all monies paid to me by you including any postage you paid (but not additional costs of delivery services above the value of second class Royal Mail delivery) within 14 days of receipt of the returned goods, less any costs due under this contract. Please see point 5.1 for exemptions.

5.9 This cancellation policy does not affect your legal rights - for example, if goods are not of satisfactory quality or have been incorrectly described (see section 6).

 

6. Unsatisfactory quality, unfitness for purpose and misdescription

6.1 It is my responsibility to supply you with goods and services that meet your consumer rights. If you have any concerns that I have not met my legal obligations, please contact me at loulou.powers@gmail.com.5 All goods and services are sold subject to your statutory rights as a consumer. These rights are that goods and services sold to you comply with the following conditions of sale. Goods and services purchased are:

·         Of satisfactory quality

·         Fit for purpose

·         As described

6.2 Goods are sold subject to your statutory rights as a consumer. If goods are sold to you that do not comply with the conditions of sale, these rights allow you to:

  • Reject the goods within a reasonable period of time and receive a full refund

 

  • Request that the goods be repaired or replaced at my expense

·         If not repaired or replaced at your request within a reasonable time, reject the goods    and receive a full refund

6.3 If the goods do not comply with the conditions of sale, please return the goods to me within 28 days of delivery and email me at loulou.powers@gmail.com, indicating whether you wish to receive a refund, a replacement or a repair. 

6.4 If you request a replacement or a refund, this will be arranged without unreasonable delay and without charge; however, replacement goods and refunds will not be despatched until the original goods have been received by me and checked. I will reimburse you for the postage costs of returning goods that are not of satisfactory quality. 

6.5 Refunds will be made using only the same mechanism that was used to pay for goods.

6.6 If, in my reasonable opinion, the goods are of satisfactory quality, I will return them to you; however, you will be required to cover my reasonable postage costs and I will not issue a refund for the cost of the goods.

7. Liability 

7.1 The services and goods sold through this website are intended to comply with all relevant UK legislation. I cannot warrant or represent that they comply with any legal requirements outside the UK.

7.2 I will only be liable for losses caused by my negligence.

7.3 I do not accept liability for any consequential loss of profit, indirect losses or for losses arising out of acts outside my control unless required by law. 

7.4 My entire liability to you is, as far as legally allowed, limited to the price of the services or goods you have purchased.

8. Copyright

8.1 I own the copyright in all designs on my products. I give permission for photographs and videos showing my designs to be posted on social media provided I am credited with creating the designs and/or my copyright notice is clearly visible on such photographs or videos. My designs must not be used for producing other items, especially where these other items are intended for sale.

9. Complaints

9.1 Please send any complaints to loulou.powers@gmail.com.

9.2 I will acknowledge receipt of your complaint within 24 hours.

9.3 I will respond fully to your complaint within 7 working days.

10. Law and Jurisdiction

10.1 These terms and conditions shall be governed by and construed in accordance with English law. Any dispute arising in connection with these Terms and Condition is subject to the exclusive jurisdiction of the English courts.
